DATA SUBJECT
A data subject is any natural person who provides personal data to the operator in connection with using the operator's services or in connection with expressing interest in the operator's services. A data subject also includes a natural person acting on behalf of a legal entity, if this natural person provides their personal data in connection with using the operator's services or in connection with expressing interest in the operator's services.
PERSONAL DATA
Personal data refers to any data on the basis of which a data subject is identified or identifiable. The scope of personal data processed by ADVISON depends on the purpose for which this personal data is processed.
The scope and list of processed personal data result from a specific contractual or pre-contractual relationship, or are directly provided by the data subject in the granted consent.
The operator obtains personal data directly from the data subject or from third parties who provide data about the data subject (e.g., public authorities, legal representatives, authorized persons, and others).
DEFINITION OF PERSONAL DATA PROCESSING
The scope of personal data processed by the operator depends on the data subject's request addressed to the operator.
After a service is ordered by the data subject via the operator's website, the operator requests data from the data subject for the purpose of providing the ordered service, including name, surname, phone number, or email address.
Depending on the type of service provided, the operator may process, in addition to the above-mentioned personal data, the following personal data: address of residence, nationality, date of birth, personal identification number, identity document and data stated thereon, image, place of birth, father's name and surname, mother's name and surname, maiden name.
PURPOSE OF PERSONAL DATA USE
The operator processes and uses the data subject's personal data for several purposes and on the basis of the legal grounds listed below.
1. Ensuring communication between the operator and the data subject
- Ensuring communication via the operator's customer form, which is published on the website where the operator handles requests and related communication with the data subject. In such a case, the operator processes the data subject's personal data to the extent of name, surname, email address, and possibly phone number. The data subject agrees to such processing of personal data by filling out and submitting the customer form.
- Sending information about job positions at the operator to data subjects who have expressed interest in a job position at the operator.
2. Performance of a contract to which the data subject is a party, or to take steps at the request of the data subject prior to entering into a contract
- Conclusion of a valid contract between the operator and the data subject and for the purpose of its proper fulfillment by both contracting parties.
- Prior to concluding a contract, for the purpose of handling the data subject's request related to the provision of a service by the operator, sent via the customer form or email.
3. Ensuring the legitimate interests of the operator
- Enforcement of any claims arising from the contract between the operator and the data subject.
- Use of cookies without any profiling of the data subject and without the possibility of identifying a connection between the data subject and a specific IP address. Detailed information about cookies used on the operator's website and consent to their use can be found HERE.
- For marketing purposes, especially for promoting the operator's services to the operator's clients.
4. Fulfillment of the operator's legal obligations
- The operator processes the data subject's personal data in accordance with relevant generally binding legal regulations governing the obligation to retain personal data or documentation containing such data, particularly regarding the retention of personal data about the data subject stated on a contract, order, or invoice in the operator's accounting, and in the internal business activity database. This may also include personal data that the operator is obliged to disclose to state or other public authorities supervising the operator's activities, or to entities that resolve disputes or enforce decisions.
PERSONAL DATA RETENTION PERIOD
The operator stores and archives the data subject's personal data for the period for which the data subject has given consent or for the period stipulated by applicable legal regulations.
In the case of processing personal data of data subjects with whom the operator has concluded a contract, the operator retains the processed data for the duration of this contract and typically for 5 years after the termination of such contractual relationship.
PROVISION OF PERSONAL DATA TO THIRD PARTIES
The operator may provide the data subject's personal data to other trusted persons if it is necessary for the performance of a contract, or if the data subject has given consent for such provision.
Such persons include, for example, a partner law firm, a notary office, a bank, an accounting service provider, the creator, operator, and administrator of the operator's website, and an IT service provider. Third parties may use this personal data of the data subject exclusively in connection with the fulfillment of the contract's purpose or for the purpose of providing additional services by the operator to the data subject.
PROVISION OF PERSONAL DATA TO THIRD COUNTRIES OR INTERNATIONAL ORGANIZATIONS
The operator does not provide the personal data it processes to entities in third countries or international organizations.
DATA SUBJECT RIGHTS RELATED TO PERSONAL DATA PROCESSING
The data subject has the right to access their processed personal data. Therefore, they have the right to request confirmation from the operator as to whether their personal data is being processed. If the operator processes the data subject's personal data, upon the data subject's request, a copy of the personal data will be issued to the data subject. The first copy is free of charge, and for each subsequent copy requested by the data subject, the operator may charge a fee corresponding to the administrative costs incurred in issuing the copy. The data subject may also make requests to the operator by electronic means. In such a case, the requested information will be provided to the data subject via email, unless they request a different delivery method.
The data subject has the right to rectification of personal data. This applies when the operator holds inaccurate personal data about the data subject in its records. This right also includes the data subject's right to have incomplete personal data completed. The operator will rectify or complete the personal data after the data subject requests or informs them to do so.
The data subject has the right to erasure of personal data. This right belongs to the data subject provided that: personal data has been processed unlawfully, personal data was collected in connection with the offer of information society services to a child under 16 years of age, personal data is no longer necessary for the purposes for which it was collected or processed, the data subject withdraws consent on which the processing is based, the data subject objects to the processing of personal data, or the reason for erasure is the fulfillment of a legal obligation or an obligation arising from another generally binding legal regulation or international treaty by which the Slovak Republic is bound. The operator will erase the processed personal data upon the data subject's request, immediately after reviewing and evaluating the request as justified. The operator will not carry out the erasure if the processing of personal data is necessary for compliance with a legal obligation or an international treaty by which the Slovak Republic is bound, for the performance of a task carried out in the public interest or in the exercise of official authority vested in the operator, for reasons of public interest in the area of public health, for archiving purposes in the public interest or statistical purposes, and for the establishment, exercise or defense of legal claims.
The data subject has the right to data portability of processed personal data after the operator has provided the processed personal data in a commonly used and machine-readable format, to another operator. This applies if the personal data was obtained by the operator either on the basis of a contract or with the data subject's consent, and its processing was carried out by automated means.
The data subject has the right to restrict the processing of personal data if the operator has no legal basis for processing personal data and the data subject requests restriction of processing instead of erasure of personal data.
The data subject has the right to withdraw their consent to the processing of personal data at any time, provided that the personal data was processed based on the granted consent.
The data subject has the right to lodge a complaint with the Office for Personal Data Protection of the Slovak Republic pursuant to Section 100 of the Act.
The data subject has the right to object to the processing of personal data pursuant to Section 27 of the Act, if:
- the operator processes personal data solely for direct marketing purposes, including profiling to the extent that it relates to direct marketing. In such a case, the operator will no longer process the data subject's personal data,
- the data subject does not have this right in cases where the processing of personal data is necessary for the performance of a task carried out for reasons of public interest, if personal data is processed for scientific, historical research or statistical purposes pursuant to Section 78 para. 8 of the Act,
- the operator will assess the received objection and, if they cannot demonstrate compelling legitimate grounds for the processing of personal data which override the rights or interests of the data subject, or grounds for the establishment, exercise or defense of legal claims, they must no longer process the objected personal data.
