Electronic Communication with the Slovak Tax Office: When Is It Mandatory and What Should Foreign Managing Directors Know?

A Slovak s.r.o. entered in the Commercial Register must deliver its submissions to the Financial Administration electronically under §14 of the Tax Procedure Code — even if it is not VAT-registered. The director's nationality or residence does not remove that corporate duty.

The short answer

A Slovak s.r.o. entered in the Commercial Register must deliver its submissions to the Financial Administration electronically under §14 of the Slovak Tax Procedure Code. This is true even if the company is not registered for VAT. The director's nationality or residence does not remove that corporate duty. Tax Procedure Code, §§13–14.

Use the Financial Administration Portal (PFS) and its designated data interface for a prescribed structured tax return or statement. A properly authorised accountant, tax adviser, lawyer or other representative can file on the company's behalf, so the foreign director does not necessarily need a Slovak electronic ID for the company's filings. The individual who acts needs the right legal authority and the relevant technical portal authorisation.

Official decisions and requests are normally delivered through the state electronic mailbox on Slovensko.sk (ÚPVS) when the relevant mailbox is activated for delivery, or to a duly appointed tax representative under the delivery rules. The special Financial Administration Portal message-box route for certain foreign taxpayers does not arise simply because a Slovak company's director lives abroad. What “electronic communication” includes

It covers electronic submissions (a return, statement, application or reply); delivery from the authority (a decision, request or notification); access to the company's tax records and filing history; and actions performed through a representative. An ordinary email or an uploaded scan is not, by itself, the statutory route for a prescribed structured tax form. Identify the action before choosing the channel.

When must a Slovak company file electronically?

Under §14(1)(a), the electronic-submission duty applies to a taxpayer that is a VAT payer, or a legal person entered in the Commercial Register, or a self-employed natural person registered for income tax. The categories are alternatives. Under §14(1)(b)–(d), tax advisers and lawyers representing taxpayers, and another representative of a taxpayer in category (a), also have the relevant electronic-filing duty. Attachments may be delivered otherwise under §14(2), but that does not turn a prescribed structured return into an ordinary PDF attachment. Tax Procedure Code, §14.

Does a non-VAT Slovak s.r.o. have to file electronically? Yes. The company's Commercial Register entry is an independent ground. VAT registration determines which VAT obligations may arise; it is not the test for whether an ordinary registered s.r.o. uses electronic tax submissions. A company can be non-VAT and still need to submit its corporate income-tax return electronically when that return is due.

The company is the taxpayer. Its director acts for it under the company's rules of representation, or the company appoints a properly empowered representative. The director's foreign passport, EU citizenship, overseas residence or lack of a Slovak eID changes the practical access route, not the basic duty of the registered Slovak company.

The PFS e-file / eSpis may also display documents and history; a display of an official document there does not justify ignoring the original delivery route or its effective date. Where should tax returns and other structured forms go?

If a submission has a prescribed structured form, §13(5) permits it only through the specialised portal operated by the Financial Directorate via the designated data interface. For a Slovak business this means using the Financial Administration's relevant electronic form or supported submission route. Typical examples, where applicable to the taxpayer, include the corporate income-tax return, VAT return, VAT control statement and recapitulative statement. The tax in question determines whether the company must file that particular form; the company's §14 status determines its electronic-submission obligation. Can I send a tax return through Slovensko.sk, as an email or as a scanned PDF? A prescribed structured return must use the specialised portal and interface; a general ÚPVS message, email or scan does not substitute for it. A valid general submission is different: for an unstructured request or explanation, the Financial Administration describes the corresponding PFS service and, where appropriate, the official “Všeobecné podanie – Daňový úrad/FR SR” service on ÚPVS. Check the form and recipient for the specific act; do not use a general message merely because it is easier. Financial Administration: two-way communication.

If you used the wrong route, act immediately, keep the original evidence, submit correctly if still possible and follow any formal request to remedy defects. For persons with a §14 duty, §13(8)–(10) provides a process: the authority requests a curable defect to be removed within a specified period; a compliant remedy within that period preserves the date of the original submission; failure to remedy fully and on time means the submission is deemed not filed. The result depends on the actual defect and process, so do not assume that every misrouted document is instantaneously void or that it will be accepted as a return. Registration, taxpayer authorisation and signing are three different steps

  1. Register the human user. A director, accountant or adviser has a personal registration on PFS. The portal identifies the individual and assigns a user ID; it does not create a free-standing “company login”.

  2. Obtain authorisation for the company. The registered individual must be linked to the correct taxpayer, generally identified by its DIČ (Slovak tax identification number). The authority checks the person's statutory capacity, power of attorney or other valid basis and grants the corresponding access rights. An IČO (company identification number) and DIČ are different identifiers. Logging in successfully does not prove that a company appears under the user's authorisations.   3. Authorise the actual submission in an accepted way. The law requires a qualified electronic signature or another recognised authorisation method under the applicable rules. PFS's available workflow depends on the person's registration and authorisation. A login method, a right to act for the taxpayer, and the legal authorisation of a particular filed document are separate checks; do not treat possession of any eID or electronic signature as proof of all three. Can a foreign managing director comply without a Slovak electronic ID?

  1. Slovak eID

    Route: Register or sign in via the supported state route, then apply to link the company.

    Verify: Current technical compatibility, company capacity and DIČ authorisation.

  2. Supported EU electronic identity

    Route: Try the current Slovensko.sk cross-border login for this service, then complete PFS registration and company authorisation.

    Verify: Whether this specific credential and service are supported, and whether separate signature/filing authorisation is required.

  3. Suitable chip-enabled residence document

    Route: Use the supported login route if the document and service qualify.

    Verify: Credential activation, portal compatibility and the company link.

  4. No supported identification route

    Route: Arrange the published in-person identity procedure if practical, or use an appropriately empowered and authorised representative.

    Verify: The representative's legal scope, active PFS rights and process for reporting filings and received documents.

Yes, the company's compliance does not depend on the director personally owning a Slovak eID. The Financial Administration describes registration using a Slovak eID, an appropriate chip-enabled residence document, Slovensko v mobile or a supported login credential issued in another EU country through Slovensko.sk. Availability for a particular foreign document and service must be confirmed in the current login flow. If the individual has none of the supported credentials, the published procedure may require an in-person visit to a tax office with an identity document to complete the individual's registration; the subsequent company link needs its own approval. Do not promise a completely remote direct-account setup for every nationality or document. Financial Administration: registration and authorisation.

The practical alternative is to appoint an accountant, tax adviser or lawyer with an appropriate power of attorney, or another properly empowered representative, and have that individual registered and authorised to act for the company. Under §9, the power and its scope must be established and delivered to the tax authority to take effect toward it. The fact that someone prepares accounts, holds a commercial services contract or knows a portal password does not itself make them the company's tax representative. Conversely, a legally valid power of attorney does not automatically finish the user's technical authorisation in PFS. Tax Procedure Code, §9; Financial Administration: authorisation procedure.

Check whether the representative may file only, respond to requests, inspect records, receive documents, or act across all tax matters. The written scope and the portal's access rights must match the intended work. Section 9 also limits overlapping representation in the same matter; obtain advice on the chosen scope when several professionals are involved. If an appointed tax representative is resident or established outside the EU/EEA, §9(2) has an additional requirement for a delivery representative in Slovakia; verify that arrangement before relying on an overseas representative. The director still needs an internal reporting process: who approves a return, who sends proof of filing, and who escalates a request.

EU nationality does not guarantee that every national eID works with every Slovak service. A non-EU director does not create a tax-filing exemption. Both can manage the company's process from abroad through a correctly authorised representative, while any direct-registration route depends on the actual credential and current portal requirements.

Can an accountant, lawyer or tax adviser file for the company?

Yes, if the person has the required authority and working PFS authorisation. Section 14 explicitly covers tax advisers and lawyers acting for represented taxpayers and other representatives of a taxpayer described in §14(1)(a). For an accountant, establish the authority to represent the company in tax administration (normally a suitable power of attorney), deliver it to the authority, have the individual registered and linked to the company's DIČ, and agree on who authorises each filing. Where a firm rather than an individual is the representative, verify the additional authority for the actual person acting for that firm. When changing accountant or adviser, revoke or amend the legal power in a way effective toward the tax authority and check the portal authorisations, document handover, submission evidence and delivery arrangement. A private contract termination does not by itself prove that the tax authority has received a revocation or that all technical access has disappeared. Where does the Slovak Tax Office send decisions and requests?

For an ordinary Slovak s.r.o. with an activated state mailbox, expect official tax-office documents in the company's Slovensko.sk/ÚPVS electronic mailbox, subject to the specific document and addressee. If the company has a representative with a tax-administration power of attorney, §30(3) says that service is made only on the representative; if the taxpayer must perform an act personally, service is made to both. Confirm the representative's actual scope before deciding which mailbox to monitor. Some special situations may produce paper delivery, for example if an electronic mailbox cannot be identified or is not activated for delivery. The Financial Administration also describes delivery into a PFS personal message box for a foreign tax subject (or a Slovak tax subject with a registered seat/permanent residence abroad) without an established or activated ÚPVS mailbox, if a PFS box exists. Here the tax subject is the Slovak s.r.o., whose seat is in Slovakia, not its foreign director as an individual. Do not switch the company's expected delivery channel merely because its managing director is a foreign national. Financial Administration: delivery branches.

When is an electronic tax-office document legally delivered?

The answer depends on the delivery regime. Under §32 of the eGovernment Act, an official electronic message delivered to a non-authority addressee other than into own hands is delivered on the day immediately following its deposit in the electronic mailbox. A message delivered into own hands is delivered when the electronic delivery receipt is confirmed or when the statutory storage period expires, whichever comes first, even if the recipient did not learn of it. The default storage period is 15 days from the day following deposit, unless a special provision supplies a different period. A request or decision for which the date of delivery starts a potentially prejudicial deadline is among the documents that the Tax Procedure Code requires to be delivered into own hands. Check the actual delivery record and any applicable special rule before calculating the response deadline. eGovernment Act, §32; Tax Procedure Code, §31.

What if the director never opens the message? If the own-hands storage period expires, deemed delivery can occur despite the director's ignorance or absence abroad; for ordinary delivery the next-day rule may apply. A notification email is only an alert, not the legal event of delivery. Build primary and backup monitoring for the actual recipient's mailbox, especially when the representative receives tax correspondence. What if the company filed incorrectly or PFS is unavailable?

For a paper filing by a §14 filer, a scanned tax return, a structured return sent by general ÚPVS service, a missing legal authorisation or an incorrect prescribed form, check the specific defect and tax authority's request to remedy it under §13(8)–(10) and, for returns, §17(5). Preserve the first submission and any receipt; correct within the specified period using the appropriate channel. Timely full remedy preserves the original submission date under §13(9); a failure to remedy has the opposite statutory result. A late filing is a separate timing question. Do not assume an email, draft form or screen saying “sent” establishes a correctly accepted return. Tax Procedure Code, §§13, 17.

If a portal is unavailable near a deadline, record the error and time, keep screenshots and relevant outage notices, contact the Financial Administration's official technical/help channels, and ask the tax adviser to assess the correct procedural action for the particular filing. Distinguish a public-service outage from a problem with an individual computer or credential. Do not assume that a deadline extends automatically. The safer working practice is to arrange access and test the workflow before a deadline day.

How can a director verify that a return was actually filed?

Ask the person filing to provide the final submitted form identifying the correct company and DIČ, the electronic submission or acceptance confirmation, its date and time, any later processing status or correction request, and a note of the tax period. In PFS, check the relevant company's personal internet zone and communication history, including sent documents and confirmations, according to the user’s access rights. What should a newly incorporated Slovak company set up first?

Confirm the new company's Commercial Register entry and identifiers (IČO and assigned DIČ when available). Decide who will make filings; establish that person's actual authority and PFS registration/authorisation to the company. Identify who can access and monitor the company's state mailbox and who checks whether tax correspondence will go to a representative. Configure reliable alerts and a backup person, then make a documented handover of filing evidence and open matters. What should you check after buying a Slovak ready-made company?

A share transfer does not create a new taxpayer. Take over the existing company's records and examine the PFS users linked to its DIČ, powers of attorney and their effective scope, previous filings and receipts, unread or recently delivered official documents, open deadlines, and who monitors the state mailbox. Confirm which accountant has the books and current authority. Revoke or change obsolete powers toward the tax authority, remove unnecessary technical access, update alerts, and document the handover. Do this even for a company marketed as having no business history; its legal identity and state communications still predate your takeover. Replacing a director likewise requires a practical access and delivery audit. Confirm who may act under the company's current corporate documents and register information, arrange the new person's portal route if needed, update authorisations and tax representation, remove unneeded old access, transfer alerts and give the new director all open documents and deadlines. Do not assume a shareholder or director change mechanically resets every PFS link or third-party power of attorney.

Dormant companies, physical mail and multiple directors

A company with no trading activity remains a legal taxpayer. The particular return obligations depend on its actual circumstances, but inactivity does not mean official messages can be ignored. Keep a named person monitoring the state mailbox and any representative's tax delivery. A virtual registered office manages the physical address and may handle paper correspondence within its service scope; it does not automatically monitor Slovensko.sk or authorise tax filings on PFS. With more than one director, check the registered manner of corporate representation and the legal basis for each user's actions. Several people may have separate portal access where duly authorised; avoid one shared personal login. Assign a filing owner, an approver and a named mailbox monitor with backup. Maintain a record of each person's portal rights, powers of attorney, notification address and handover date. These controls are recommended internal practice; the statutory filing and delivery rules still apply independently.

Polish director; non-VAT s.r.o.

The company is still within §14 because it is entered in the Commercial Register. The director may test a supported Polish-issued electronic identity against the current Slovensko.sk/PFS service, then obtain the company link and valid filing authorisation; an empowered accountant is a viable alternative. Do not assume cross-border login from citizenship alone.

US director; no Slovak eID

The registered company must use the correct electronic route. Arrange a representative with an appropriately scoped power of attorney and verified PFS authorisation; agree on approvals, filing proof and tax-office correspondence. A direct account may involve a supported credential or an in-person identity step.

Ready-made acquisition; old accountant still linked

Obtain the user and PoA record, ask who filed the last return and for whom the Tax Office currently delivers, review open communications and receipts, then revoke toward the authority and remove obsolete technical rights. A share transfer alone is not proof this happened.

Tax-office request during the director's holiday

The effective delivery date follows the actual electronic delivery regime and addressee, possibly a representative. A holiday or unread notification does not by itself suspend the clock. The named backup checks the document, records the date and escalates the deadline.

Assuming non-VAT status or a foreign director removes the electronic-filing duty; treating PFS login as company authorisation; sending a structured return as an email attachment, scan or general message; relying on an accountant's services contract without tax representation and an active company link; watching only PFS while a decision goes to Slovensko.sk or a representative; relying only on email alerts; and failing to check old access, submitted-document history and open requests after a takeover.

Frequently asked questions

Does every Slovak s.r.o. have to make every tax form?

No. The company’s electronic-submission duty applies under §14 because it is entered in the Commercial Register, but whether an individual VAT, payroll, income-tax or other form is due depends on the underlying tax rules and facts.

Can an EU director use their home-country eID?

Possibly, if that credential and the particular Slovensko.sk/PFS service support the cross-border route. Check it in the live service; registration and the company link still need completion.

Can an accountant be authorised without sharing the director's login?

Yes. Give the accountant their own valid legal authority and personal portal authorisation to the company's taxpayer record. Never share another person's personal credentials.

Is a notarised signature automatically required on a tax power of attorney?

The Financial Administration's FAQ states that §9 does not generally require a notarised signature on the power of attorney itself. Check the current submission format and any case-specific proof of identity or authority; a scan is not automatically a valid electronic filing. Financial Administration FAQ.

Why can I log into PFS but cannot see my company?

Your personal registration and login do not create authorisation for its DIČ. Check the application for authorisation, the legal basis and whether the tax authority has linked the correct taxpayer.

Can more than one person have access?

Separate individuals may be authorised where the legal basis and their access rights permit it. Check each person's scope, especially representation in the same matter, and keep individual credentials.

Will the former accountant lose access automatically when we change accountants or owners?

Do not assume so. Notify the tax authority of a revocation or change, review the legal power and remove or amend technical portal access, then verify completion.

Does an inactive company need to monitor official messages?

Yes. Inactivity does not deactivate the company’s official mailbox or eliminate the possibility of a request. Whether a particular return is due is a separate tax question.

Does an alert email start the reply period?

The legally effective delivery event follows the official mailbox, delivery receipt and applicable rules, not the email alert. Check the official delivery record.

What if we used the wrong portal for a return?

Identify the correct structured form and act promptly. The authority may request removal of defects under §13(8)–(10); timely full remedy preserves the original submission date, while failure can mean it is treated as not filed.
